Statute text
, (1) If the Department of State denies a corporation’s application for reinstatement following administrative dissolution, it shall serve the corporation under s. 617.0504(2) with a written notice that explains the reason or reasons for denial. (2) After exhaustion of administrative remedies, the corporation may appeal the denial of reinstatement to the appropriate court as provided in s. 120.68 within 30 days after service of the notice of denial is perfected. The corporation appeals by petitioning the court to set aside the dissolution and attaching to the petition copies of the Department of State’s certificate of dissolution, the corporation’s application for reinstatement, and the department’s notice of denial. (3) The court may summarily order the Department of State to reinstate the dissolved corporation or may take other action the court considers appropriate. (4) The court’s final decision may be appealed as in other civil proceedings. History., s. 85, ch. 90-179; s. 266, ch. 96-410.
